1. Acceptance of Terms

By accessing and using ShadowFlirt Chat, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service constitute a legally binding agreement between you and ShadowFlirt Chat.

2. Age Requirement

You must be at least 21 years of age to use this Service. By using ShadowFlirt Chat, you represent and warrant that you are at least 21 years old. We reserve the right to request proof of age at any time. Violation of this age requirement will result in immediate termination of access and may be reported to authorities.

3. Prohibited Conduct

Users are strictly prohibited from engaging in the following activities:

• Cyberstalking, cyberbullying, or online harassment

3.2 Sexual Content

• No nudity, pornography, or sexually explicit content of any kind
• No sexual conduct, gestures, or activities
• No sexual solicitation or proposition
• No discussion of sexual acts with intent to engage
• No exposure of intimate body parts

3.3 Hateful and Harmful Content

• Hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Threats of violence or harm to any person or group
• Harassment, bullying, or intimidation
• Content promoting self-harm or suicide
• Glorification of violence or criminal activity

3.4 Other Prohibited Activities

• Use of the Service for commercial purposes without authorization
• Spamming, advertising, or solicitation
• Recording, capturing, or distributing content from the Service
• Circumventing or attempting to circumvent any security measures
• Using automated systems or bots
• Creating multiple accounts to evade bans

4. Strike System and Bans

ShadowFlirt Chat operates a three-strike system:

1. First Strike: Warning issued for violation of Terms
2. Second Strike: Temporary suspension from Service
3. Third Strike: Permanent ban from Service

However, we reserve the right to issue immediate permanent bans for severe violations, including but not limited to:

• Illegal activity of any kind
• Sexual content or nudity
• Child endangerment
• Threats of violence
• Hate speech or harassment

Bans are determined by user device fingerprinting and may include IP blocking.

5. User Reporting

Users are encouraged and expected to report violations of these Terms. All reports are taken seriously and reviewed by our moderation team. False or malicious reports may result in penalties against the reporting user.

6. Content Monitoring and Recording

Important Notice: All video chats may be monitored and recorded for moderation and safety purposes. By using the Service, you consent to such monitoring and recording. Recorded content may be:

• Reviewed by human moderators to enforce these Terms
• Analyzed by automated systems to detect violations
• Preserved as evidence for law enforcement if illegal activity is detected
• Used to investigate user reports

We do not guarantee real-time monitoring and cannot prevent all violations in real-time.

7. Disclaimers and Limitation of Liability

7.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Liability for User Conduct

WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER. You interact with other users at your own risk. We do not screen users, conduct background checks, or verify identities. We are not liable for any harm, injury, or damage resulting from interactions with other users.

7.3 No Guarantee of Safety

While we implement security measures including face blurring, we cannot guarantee complete anonymity or safety. Users are responsible for their own privacy and security.

7.4 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHADOWCHAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any conduct or content of any user on the Service
• Unauthorized access to your data or communications
• Any bugs, viruses, or malicious code transmitted through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE LAST SIX MONTHS, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless ShadowFlirt Chat, its officers, directors, employees, agents, and third-party service providers from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of any rights of another person or entity
• Your violation of any applicable law or regulation

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

17. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and ShadowFlirt Chat regarding the use of the Service.
